Mark 15:15

And so Pilate, willing to content the people, released Barabbas unto them, and delivered Jesus, when he had scourged him, to be crucified.

The trial did not have to be fair. Pilate could do as he wished. Again, he wanted peace with the populace, so he condemned Jesus to a scourging and to death. It appears to have been common to do a scourging before a crucifixion, probably to weaken the prisoner.
